Administrative Law pertains to the law regulating Public Authorities including the Government and other State Bodies for example, An Garda Síochána, Courts Service, An Bord Pleanála, Government Departments.
Administrative Law sets out legal rules based on fair procedures and natural justice which Public Authorities are obliged to comply with when carrying out their public functions, procedures and roles. Administrative Law does not consider the merits of a Public Authority’s decision making but looks at the fairness of the procedures employed by that Public Authority in reaching its decision. It ensures fairness and restrains those in State Bodies from acting ultra vires, or beyond their legal power or authority.
If you have been subjected to an inquiry by a State Body contrary to the legal rules of Administrative Law you are entitled to seek remedy for that wrongdoing in the High Court in a process known as Judicial Review. There are strict timelines which must be adhered to when initiating Judicial Review proceedings.
We can provide advice to you on the steps required and the process involved.
